Designer Loses Bid to Protect Signature Shoes


A judge declined on Wednesday to grant a preliminary injunction requested by Christian Louboutin against Yves Saint Laurent, which was accused of trademark infringement for shoes that featured red soles similar to those of Louboutin’s.

I have mixed feelings about this. Red soles on stilettos are really iconic and Louboutin made it that way. If I'd done that I wouldn't want to see it on cheap knock-offs at payless either. OTOH, red soles seems like way too broad a thing to for one person to have a claim to. I'm conflicted.

(I really should get some more challenges ready to go for this comm, but I seem to be suffering from internet ennui just now. This last week I could hardly be bothered to boot up my laptop. Fortunately, I've put it on tomorrows to-do list.)

I think internet ennui should be taken advantage of when it's there. The inability to get off the internet strikes much more often!

It isn't like Payless was trying to do the cheap knockoffs; if he hadn't sued St Laurent, he probably would have been OK for years--now everyone knows he hasn't got a , erm, sole to stand on. I have to deal with "intellectual property" rights for work at times (broadcasting stuff) and my sympathy level for a lot of these claims is pretty low.

I have lots of to do lists. I keep adding on :)
